3. MEMBERSHIP AND SUBSCRIPTION

3.2 Payment Terms

All subscription fees are payable in advance according to your selected subscription plan. We accept payment through the methods specified on our platform. By providing payment information, you authorize us to charge the applicable subscription fees to your chosen payment method.

3.3 Automatic Renewal

Your subscription will automatically renew at the end of each subscription period unless you cancel it before the renewal date. By subscribing, you authorize us to automatically charge your payment method for the renewal period at the then-current rate.

3.4 Refund Policy

• New Members: We offer a 14-day money-back guarantee for new members. If you’re not satisfied with our Service within the first 14 days of your initial subscription, you may request a full refund.

• Renewals: No refunds will be provided for automatic renewals. It is your responsibility to cancel your subscription before the renewal date if you no longer wish to use our Service.

• Membership Termination: If we terminate your membership due to violations of our Community Guidelines, we will refund the prorated portion of your remaining subscription period.

4. ACCOUNT REGISTRATION

To access certain features of the Service, you must register for an account. During registration, you will be required to provide certain information, including your email address, name, surname, location, and languages spoken. You agree to provide accurate, current, and complete information and to update such information to keep it accurate, current, and complete.

5. USER CONDUCT AND COMMUNITY GUIDELINES

The JoClub community exists to encourage our members to grow while connecting to the world. All members must adhere to our Community Guidelines, which include but are not limited to:

• Anti-Intolerance: JoClub stands against all forms of dehumanizing or unlawful treatment of others, including but not limited to all forms of cyberbullying, cyber-harassment, hate speech, or threats based on race, ethnicity, national origin, religion, caste, sexual orientation, sex, gender, gender identity, disability, or immigration status.

• Respectful Conduct: Be kind and respectful to other members. Avoid mean, rude, offensive, or antagonistically political behavior. Challenge ideas respectfully, not people.

• No Promotion or Solicitation: Do not use the Service for promotion, solicitation, or spam.

• Relevant Discussions: Keep discussions relevant to journaling, community building, and related topics.

• Privacy Respect: Respect the privacy of others. Do not share anyone’s nonpublic personal information or use our platform to dox, extort, harass, or spread false information about others.

5.2 Violations of Community Guidelines

If we identify a violation of our Community Guidelines, we may, at our discretion:

• Delete content without notice

• Issue warnings

• Temporarily suspend your account

• Permanently terminate your account, especially for violations of our Anti-Intolerance guidelines

6. CONTENT AND INTELLECTUAL PROPERTY

6.1 Ownership

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, are owned by JoClub or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.

6.2 Recording of Sessions

Please note that sessions are recorded for rewatching purposes in our video library. By participating in sessions, you consent to being recorded and to these recordings being made available to other members through our video library. Members are strictly prohibited from downloading, sharing, distributing, or using these recordings for any purpose other than personal viewing within the JoClub platform. Any unauthorized use, reproduction, or distribution of recorded sessions, including but not limited to sharing on social media, other websites, or with non-members, is a violation of these Terms and may result in immediate termination of your membership and potential legal action.

7. PRIVACY

Your privacy is important to us. Our Privacy Policy describes how we collect, use, and disclose information about you. By using the Service, you consent to the collection, use, and disclosure of information as described in our Privacy Policy.

8. TERMINATION

8.1 Termination by You

You may terminate your account at any time by following the instructions on our website or by contacting customer support. Upon termination, your right to access and use the Service will immediately cease.

8.2 Termination by Us

We reserve the right to suspend or terminate your access to the Service, without prior notice or liability, for any reason, including if you breach these Terms or our Community Guidelines. Upon termination for violations, we will refund the prorated portion of your remaining subscription period.

10. LIMITATION OF LIABILITY

IN NO EVENT SHALL JOCLUB, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
